ABS-CBN is at Willie Revillame again files a P127 M copyright suit!

ABS-CBN has lodged a P127 million copyright suit against its former talent, Willie Revillame, his production outfit (WilProductions, Inc.), and ABC5 , now known as TV5,  before the Makati Regional Trial Court (RTC). ABS-CBN had also filed for Temporary Restraining Order to stop Revillame, TV5 and their other co-defendants from further producing and airing the show Willing-Willie.

Among the acts of plagiarism listed in the complaint are:

  1. Willing Willie’s opening song and/or dance number led by its host;
  2. Wowowee’s Biga-10 as against Willing Willie’s Big Time Ka;
  3. Wowowee’s Willie of Fortune versus Willing Willie’s Willtime Bigtime, which contain portions where the contestants tell their personal stories and showcase their talents before they play a singing and/or trivia game;
  4. Wowowee’s dancers/characters also appearing in Willing Willie, most notable of whom is April “Congratulations” Gustilo; and,
  5. The set design, stage, studio viewers’ seats lay-out, lighting and camera angles of Willing Willie are also strikingly similar to Wowowee.

Willie Revillame asked the court to junk ABS-CBN claim!

TELEVISION host Willie Revillame, who was reported to have earned P40 million a month for hosting a daily noontime show on television, has asked a Quezon City court to ignore the “compulsory counterclaims” filed by his former employer ABS-CBN, describing the close to half a billion peso amount as “horrendous.”

In the petition filed by Revillame in Quezon City Regional Trial Court Branch 84, he also asked to be allowed to present evidence ex parte, or without the representation or notification of defendant ABS-CBN, in the civil case he filed for judicial confirmation of his rescission of his contract as host of the show “Wowowee” aired over the giant network.

The TV personality also requested the court to be allowed to present on Sept. 30 evidence of his plea for a confirmation of the rescission of his contract.

In his petition, the TV host also requested the court not to give weight to the counterclaim filed by the TV network because of its failure to pay the docket fee.

“Defendant ABS-CBN did not deign to, as it did not, pay the required docket fee. Consequently, the compulsory counterclaims asserted by ABS-CBN should be stricken from the records,” the motion said.

“It is as if no answer was filed by defendant ABS-CBN within the reglementary period. As a result, the network should be declared in default,” it added.

The TV host had filed a P11.5-million damage suit for rescission of contract in August after a falling out with the network’s management.

ABS-CBN last week filed its counterclaim against Revillame, asking the court to order the TV host to pay P426 million in damages for breach of contract and P20 million each for moral damages, exemplary damages and attorney’s fees.

Court asked ABS-CBN to answer Willi Revillame's P11M damage suit!

A broadcasting network giant has been asked by a local court to answer a civil suit filed by one of its hosts seeking the termination of his contract with the network and the payment of damages totaling P11 million.

In a one page summons, the Quezon City regional trial court Branch 84 ordered ABS-CBN Broadcasting Network to submit its answer to Willie Revillame’s complaint within 15 days of receipt.

Revillame, host of “Wowowee,” lodged a complaint for judicial confirmation of rescission of contract with damages with the court.

The host and comedian also asked to be awarded P11 million in damages, aside from a court confirm that his contract with ABS-CBN has been terminated.

The court summons reminded the network to observe restraint in filing a motion to dismiss and “instead allege the grounds thereof as defenses in the answer.”

“If you fail to answer within the time aforesaid, the plaintiff will take judgment against you by default and may be granted the relief applied for in the complaint,” said court clerk Mary Anne Plata Daytia.

The summons was served last August 31 by court sheriff Franklin Dazo on Maxim Uy, chief legal counsel of the network giant.

Last month, Revillame lodged the complaint docketed as Q-10-67770 in which he alleged that the network suspended him without pay, cancelled his show unilaterally, and downgraded his program from three hours daily or 18 hours weekly to just one hour weekly, or 17 hours less.

Apart from confirming the termination of his contract, Revillame asked the court to award him P5 million in moral damages, P5 million in exemplary damages, attorneys’ fees of P1 million, as well as P500,000 for litigation costs.

“Plaintiff has, for valid reasons, rescinded his contract with ABS-CBN Broadcasting Corp. However, ABS-CBN publicly disputed the rescission and claimed it was the aggrieved party. So the public may know the truth as to who really is the aggrieved party, who truly is at fault, who has been insincere, who acted with evident bad faith, and who broke promises, plaintiff desires to have his rescission judicially confirmed.”

Revillame said he ended his contract with ABS-CBN “for valid reasons” but the giant TV network has publicly disputed it, saying the network was the aggrieved party.

Revillame added that because of his show’s cancellation, he would be deprived of his earnings from “in-show” product endorsements which was part of his compensation package.

Willie Revillame sued ABS-CBN for 11.5 M!

Apparently a victim of injustice and undeserved humiliation, Willie Revillame, dynamic host of the vastly popular television noonday show Wowowee, has decided to fight back and sue television corporation giant ABS-CBN for damages amounting to at least P11.5 million.

Willie wrote ABS-CBN last August 9, formally rescinding his contract with the television firm, but the latter had publicly disputed the rescission and claimed it was the aggrieved party.

So Willie filed the complaint, asking the Quezon City Regional Trial Court to judicially “confirm the rescission of the contract with damages,” Willie said he wants to have the rescission “judicially confirmed.”

The contract with ABS-CBN had a term of three years, commencing on September 11, 2008, and ending on September 10, 201l. In the nearly two years that Willie hosted the show, it moved to the top ranking of television shows, generating 22 to 23 percent of viewership. After he stopped hosting the show, viewership dropped to just nine percent, indicating that the public sorely missed the program on their noonday TV.

It was therefore quite a shock to Willie that a broadcaster, perhaps with an axe to grind, started to viciously and personally attack Willie in his show in a sister radio station of ABS-CBN.  When he appealed to ABS-CBN bosses to stop the unjust tirade, he was given the cold shoulder.  Anybody in Willie’s situation would have reacted angrily.
A series of events happened subsequently pulling out the rug from under Willie, who did not know what hit him as he believed he had done nothing wrong to deserve them.

These obviously unfair blows were:

Suspension without pay;  unilateral cancellation of the Wowowee program due to reasons not attributable to Wilie;  unilateral downgrading of his program from three (3) hours daily (Monday to Saturday) or eighteen (18) hours weekly to one (1) hour weekly or seventeen (17) hours less;

Being placed on probation to a weekly program without assurance to reinstatement to daily programming; unilateral downgrading of his appearance from a “live” to a “pre-recorded” program which constitutes prior restraint and censorship; deprivation of his earning from “in-show” product endorsements which has become part of his compensation package;

Deliberate sabotage of Willie’s image by the Company by airing, or allowing to be aired, destructive pieces against him; abuse of right by the company under a one-sided contract, purposely intended to destroy Willie’s career and humiliate him;

Refusing to salvage the Wowowee program by reinstating Willie as host when the rating started to decline with different trial hosts who did not generate the same viewership of 22-23% under his watch.

Further, Willie was ordered to continue to work under probation, censorship and prior restraint. This, according to Willie, constitutes “involuntary servitude”, a violation of human rights under the Constitution.

His claim for moral damages arose not only from his humiliation over the incessant personal attacks made against him by broadcaster Jobert Sucaldito if ABS-CBN, but also allegedly due to deception perpetrated against him when ABS-CBN, through emissaries, assured him that he would return as Willie of Wowowee on 31 July 2010.

The dispute with Willie has undoubtedly tarnished the reputation of the dominant top-rated ABS-CBN television firm for fair treatment of its talents and employees. On the other hand, in fighting back against ABS-CBN, Willie is taking up the role of a David fighting a Goliath. And everybody knows that David has retained the support and sympathy of the people for many generations.

Pokwang finally speaks-up on the negative write-up and about Willie Revillame!

After three months of silence Pokwang finally speaks up on The Buzz about the wish of Willie Revillame that he wants her out of ”Wowowee”. How she copes and her family copes up with it. And the press that writes negatively about her. Charlene Gonzales interviewed her intensively about the intrigues.

Here are some excerpts from the interview:

Lumaki na ang ulo at yumabang na:

“Kasi, ganun yata talaga kapag alam mo ang karapatan mo, alam mo na kung papano mangatwiran, alam mo na kung kelan ka nasasaktanPag lumabas ‘yong boses mopara sa kanila malaki na ang ulo.  Siguro kung talagang lumalaki na ang ulo ko  wala ng kukuha sa akin sa mga shows, Di ko po mamgagawa ‘yun at ‘pag nawalan ako ng trabaho paano naman po ‘yung umaasa sa akin? Kaya hinding-hindi ko po magagawa ang magmalaki.”

Her mother is affected with the issues that hounds her and that saddened her.

When she heard the news that Willie wants him out when he returns to “Wowowee“:

“Siyempre po nagulat ako kasi bilang ginagawa lang po namin ang trabaho, sa dami pa po ng mas maliliit ang suweldo sa amin sa Wowowee, mas kailangan po nila ng trabaho talaga.”

On her relationship with Willie:

“Siguro dahil na lang po sa nasa paligid diyan na pilit pinaglalayo ang landas namin. Sa totoo lang wala akong ano kay Kuya (Willie). Hindi po totoong wala akong utang na loob, na ingrata ako. Marunong po akong tumanaw ng utang na loob,” pagdidiin niya. “Kaya lang kasi magsalita ka’t hindi, sila ang magiging husga… ang mga malalapit sa kanya.”

Her message to Willie:

“Nagkasakitan tayo, nasaktan kita and nasaktan din ako sa mga nangyayari. Pasensiya na Kuya pero isa lang talaga ang wish ko sa birthday ko, mawala na ang lahat ng mga ito (intriga)…napakaliit ng industriyang ito, alam ko one day magkakaharap din kami.”

ABS-CBN disclosed Willie Revillame's demands!

MANILA, Philippines – Willie Revillame wanted Wowowee co-hosts Pokwang and Mariel Rodriquez axed from the noontime show as a precondition for his return, an ABS-CBN official disclosed on Friday.

In an interview with ABS-CBN News, Linggit Tan, ABS-CBN senior vice-president for TV entertainment, said this demand was another sign that Revillame had not changed his attitude, thus making it difficult for the network to come to terms with the TV host following his 3-month suspension.

Tan issued the statement in response to Revillame’s claim that ABS-CBN had reneged on an agreement that he was to return to the show on July 31. Revillame is using this as one of the reasons for rescinding his contract with the Kapamilya network.

Wala pong naging kasunduan ang management ng ABS-CBN at si Willie na babalik na siya sa Wowowee noong July 31. Ang suspensyon ni Willie ay matatapos po sa August 24 pa. Si Willie ang may gustong bumalik na siya sa Wowowee noong July 31. Ang totoo po, wala pang desisyon ang management noon, bilang pagbibigay halaga sa damdamin ng mga manonood na ang iba ay tutol po talaga sa kanyang pagbabalik sa telebisyon dahil sa inasal niya noong May 4 at mga iba pang pangyayari noon,” Tan said.

Isang patunay na hindi pa siya nagbabago ay ang pagbibigay niya ng mga kondisyon sa kanyang pagbabalik. Pinapatanggal po niya sina Mariel Rodriguez at Pokwang sa programa at dapat din daw siyang suwelduhan habang siya ay suspendido. Kaya’t marami pa kaming dapat pag-usapan at ayusin. Naniniwala ang management ng ABS-CBN na dapat isabuhay muna ni Willie ang pinahahalagahang values at work ethics ng kompanya bago siya bumalik sa telebisyon,” she added.

In reply to Revillame’s August 9 letter, ABS-CBN, represented by the law firm Villaraza, Cruz, Marcelo, and Angangco, also disclosed that aside from demanding the removal of all female hosts of Wowowee, Revillame also asked for the following:

  • Payment of talent fee during the period of the suspension of the talent agreement;
  • Return of DJ Coki and Ana Feliciano to Wowowee;
  • Change of program from Wowowee to Wowowin;
  • Inclusion of Pinoy Big Brother winner Melai as host of the show;
  • Special ID cards for staff of Wowowee;
  • Special vehicle access privilege for the TV host in restricted areas within the ABS-CBN compound.

ABS-CBN’s Tan “did not grant nor agree” to Revillame’s demands. Thus, the company said “there could not have been an agreement on a definite date” for Revillame’s return to television.

“Clearly, therefore, there is no truth that Ms. Tan informed you on 10 July 2010 that you would return as host of Wowowee on 31 July 2010,” the network’s lawyers said.

In a meeting on July 13, the network’s lawyers also argued that ABS-CBN President Charo Santos-Concio informed Revillame that the suspension of the TV host’s talent agreement was to last until “August 24, 2010. Thus, the earliest Revillame could return was after that date.

However, Revillame didn’t want to return in August since it was an “unlucky month to do so,” the lawyers said.

You cited several bad experiences in your personal life and career that occurred in the month of August. Since a return on 31 July 2010 was not possible, this led to a consideration of other dates for your possible return to the program,” the lawyers said.

The earliest Revillame could return to the show was sometime in September 2010.

In the meeting with Santos-Concio, the lawyers said Revillame was told that “public sentiment was still mostly against your return to television and that there was a need to rehabilitate your image and name.’

Revillame, in response, said he was ready to return to television as late as January 2011, “if this was what ABS-CBN management thought was best under the circumstances.”

Revillame supposedly mentioned this was “worth considering” since a return in January 2011 would coincide with his 50th birthday.

Santos-Concio, during the meeting, also told Revillame he needed to change his attitude before his return to television.

During the last meeting between Tan and Revillame on July 20, the lawyers said Tan informed Revillame that management “had finally decided that a return to Wowowee was no longer an option.”

This was due to the fact that studies and feedback received by ABS-CBN had shown that the viewing public was still not in favor of your return to television because of the incident of 4 May 2010 and that it was advisable to gradually build the public’s acceptance of your presence on television,” the lawyers said.

This was why Tan opened discussions for an alternative program, including one that was pre-recorded instead of live.

Revillame announced last week his desire to end his contract with ABS-CBN, which the network said was binding until September 2011. His lead counsel Leonard de Vera said they are seeking legal protection for Revillame given ABS-CBN’s newest statement.

As a consequence of the letter of Atty. Villaraza which in effect warns Willie and those who may want to contract with him while ABS-CBN keeps Willie in the freezer, Willie is now compelled to seek the protection of the courts of law,” De Vera said.

After the press conference that Willie Revillame where he issued a statement, now after few weeks ABS-CBN issued a statement refuting all the claims that Willie said.

Mr. Bong R. Osorio, Head of ABS-CBN Corporate Communications, released a statement regarding Willie Revillame‘s latest claims against the Kapamilya network.

Willie Revillame who is in Boracay right now with friends, cast and crew from his former show “Wowowee” and former network for a rest and recreation, and they are brewing up their next show to be aired on TV5 soon!

Willie Revillame just inked a multi billion deal with TV5 through his new manger and entertainment tycoon Vic del Rosario. Willie is just waiting for the right timing and before he starts making formal announcement he wants all the legal issues cleared first before anything else.

His new show is already all set and ready up to the smallest details, let us just wait for his formal announcement between today and middle of September.

Now it can be told, Willie Revillame was offered by ABS-CBN to host Wowowee again the day before he went on and announced that he is quitting ABS-CBN!

ABS-CBN released an official statement on Willie Revillame's contract!

ABS-CBN released an official statement upon learning that Willie Revillame end his contract with them.

The following official statement from ABS-CBN:

We take note of Willie Revillame’s pronouncements in his press conference today.

Willie is bound to ABS-CBN by a contract until September 2011. He violated the behavioral provisions of his contract when he threatened the ABS-CBN management during the May 4, 2010 episode of Wowowee, with a resignation if management does not fire another artist of the network. His behavior was generally seen as a display of disrespect and arrogance, completely unacceptable to the Filipino public.

As the one who violated his contract, Willie has no right to have it unilaterally invalidated. Contracts are binding agreements that must be respected by the contracting parties involved. The one who violates the contract cannot be allowed to dictate whether it should continue or end. Otherwise, contracts will have no value and may be terminated based on whim.

ABS-CBN is the aggrieved party, and as such, is the only one that can decide to end the agreement.

Despite all that had happened, ABS-CBN was willing to continue with the contract. Willie, however, refused to take responsibility for his actions.

ABS-CBN wishes to reiterate that it will hold Willie to his obligations under the contract which expires September 2011.
